Confidentiality & Intellectual Property Rights

1.  Confidentiality
All commissioned photography is subject to client confidentiality, from the creation of images and during the licensing period, with security sensitive images - client confidentiality is respected beyond the licensing period, or non security sensitive images by request.
2.  Intellectual Property Rights
The photographer will always maintain Intellectual property rights, ownership and copyright of the Raw file/Digital Negative and all images produced from it - negotiating terms of license for the use of the image/s, this can be anything from a one off small internal publication to full world usage over a number of years.
Beyond Original Licensing
Although photo images do become outdated with time, if an image/s is seen to be useful beyond the expiry of the original licensing agreement an extension of the licence can be negotiated for a nominal fee; to which rewards the photographer for extended intellectual creativity.
3.  Photographers Own Publicity
The photographer reserves the right to use commissioned images for his own publicity; this is undertaken with integrity and high regard to client confidentiality; should a commissioned image be selected for the photographers promotion andSecure is within the clients licensing period, the client/agent would be prier notified/ advice sought. Should the copyright and ownership of images be surrendered to the client/agent; this is normally a separate negotiation cumulating a financial reward and all RAW files/ Digital Negatives being furnished to the client/agent.
4.  RAW Files
With all professional photography including commissioned photography the photographs are captured and stored in a RAW file format (Raw image files are sometimes called digital negatives, as they fulfil the same role as negatives in film photography: that is, the negative is not directly usable as an image, but has all of the information needed to create an image. Likewise, the process of converting a raw image file into a viewable format is sometimes called developing a raw image, by analogy with the film development process used to convert photographic film into viewable prints. The selection of the final choice of image rendering is part of the process of white balancing and colour grading to enable maximum quality of the presented viewable image/s, these images can be supplied in a number formats crops and resolutions from the RAW file/Digital Negative without ever changing, altering or manipulating this original file.

It is these Raw files/digital images which are stored and archived by the photographer. Should a client/agent loose or damage their set of images the photographer can always supply another set from the original RAW files/Digital Negatives, or indeed if the client/agent requires images in a different format i.e. Psd, Png, Tiff, Jpeg and many more file formats, also in RGB, CMYK, 8bit 16bit and even 32bit colour, all possible from the RAW files/Digital Negatives.
5.  Sale of Copyright
In the Unusual event of a sale of copyright, and after the successful transfer of data to the client/agent, all pertaining files remaining on the photographer's computer/data storage systems will be subject to destruction. It is recommended the client/agent use a reliable storage system together with compatible RAW file/ Digital Negative processing software
